Terms and Conditions for Sovereign Together & Costa Rica Retreat

Neko Three Sixty/Nicole Elko, Emily Zachar, and Zata LLC d/b/a Soul Healing Collective (each a “Facilitator” and together, the “Facilitators”) are facilitating the Sovereign Together 4-month Initiation and the optional add-on Sacred Flame of the Rose Costa Rica Immersion (collectively, the “Program”). In exchange for my being allowed to participate in the Program, I acknowledge and agree to be bound by each of the terms below (collectively, the “Terms”):

On Integrity

I hold myself accountable and I ask for help and support as needed.

On Both Curiosity + Collaboration

I understand that the most powerful growth happens when I stay open to new possibilities and to learning something unexpected, even in areas where I feel experienced. I’m willing to explore new perspectives and let myself be surprised.

I come to this process with curiosity and a desire to fully participate in the experience. I value my voice and trust that what I share matters, while also remaining open to being moved, changed, and inspired by others. I’m here to be in the exchange — sometimes leading, sometimes learning, always engaged.

On Participation and Community

I enter this space as a practice in being in community. I commit to showing up with presence and participation. I will voice my needs and limits clearly, ask for help when needed, and offer support when I can.

I understand that community is perfectly imperfect. I agree to extend grace, stay in relationship, and repair when necessary.

I vow to take responsibility for my choices, participation level, and well-being before, during, and after sessions.

I know transformation can include emotional intensity. I will pace myself and choose support when needed and ASK for what I need.

Participation is always optional. I may pass, pause, step out, or choose another practice at any time.

On Consent

I recognize the importance of being witnessed and witnessing. In this space, being heard matters more than being advised. I will listen to understand, not to fix, correct, or improve.

I agree to respectful communication and "I" language, and I will avoid unsolicited fixing, diagnosing, or coaching.

I honor that each person is the authority of their own experience. Consent in conversation is ongoing and can be clarified or changed at any time.

On Safety

Safety is personal and subjective. No space can guarantee comfort at all times.

In this space, I take responsibility for my own regulation and will ask for support when needed. I am willing to practice self-regulation and co-regulation as we move through discomfort.

If rupture arises, I commit to curiosity over defensiveness, courage over withdrawal, and repair over blame. We are here to grow — and to strengthen authenticity in our connection with ourselves and with one another.

I will not use this container to solicit, pitch, recruit, or pursue romantic or sexual access to participants or the Facilitators.

On Sacred Listening

I trust that when it comes to my turn to speak, whatever is meant to flow through me will surface. I practice active listening while another is speaking and I give them the attention I can in the present whenever possible.

On Substances

I understand that this experience is designed to support clarity, presence, and connection — with nature, with community, and with myself.

I remain open to meeting this experience with awareness, responsibility, and full presence.

I will attend sessions sober, meaning no substances that impair consent, judgment, or nervous system safety.

I understand the Facilitators may remove participants for violations of these Terms, including those related to consent, confidentiality, substances, harassment, or safety, to protect the group.

Recording Consent and Recording Rules

Because this Program is online and recorded, I understand that I will be recorded. These recordings/replays will only be available for participants to replay until June 30, 2027.

I consent to being recorded during sessions as a condition of participating in this Program.

Media Release

I agree that my image, words, and voice, including from photos/videos and audio recordings taken and recorded during this Program, may be collected and retained by the Facilitators and their Representatives. I release my rights to these materials and give permission  to the Facilitators and their Representatives to use these materials for testimonial, marketing, and promotional purposes.

Confidentiality

I agree to hold all information I receive in the Program confidentially. I will not share names, stories, identifying details, screenshots, recordings, or content outside the Program or its participants.

I understand recordings are shared privately with registered participants. I will not share, forward, repost, or distribute recordings or clips.

Participant Recording Rule

I will not record, photograph, screen capture, or transcribe any portion of the container unless explicit written permission is given.

Materials and IP

Materials provided are for my personal use only. I will not reproduce, distribute, sell, or teach them to others without written permission.

Health and Support

I am responsible for my well-being and for seeking appropriate medical or mental health support if needed. Nothing taught or provided by the Facilitators, whether verbally or in writing, is to be considered or taken as medical advice.

Liability Waiver, Assumption of Risk, and Release

I choose to participate voluntarily in Sovereign Together and, if applicable, the Costa Rica Retreat. I understand participation may include coaching, group sharing, emotional processing, somatic practices, movement, breath practices, meditation, visualization, ritual, and educational content.

I understand personal growth work can involve emotional, physical, or psychological intensity. I knowingly and freely assume all risks, whether known or unknown, related to my participation.

To the fullest extent permitted by law, I release and hold harmless Facilitators and their owners, contractors, directors, officers, employees, agents, volunteers, successors, or assigns (collectively, “Representatives”) from and against any and all liability for, and waive any and all reasonable claims, suits, damages, liabilities, losses, costs, settlements, and expenses, including claims for personal injury or economic or noneconomic damages or loss and related attorneys’ fees, arising out of my participation in the Program, including its Recreational Activities (each, a “Claim”), even if caused in whole or in part by the negligent acts or omissions or other misconduct of the Facilitators or any of their Representatives.

Results are not guaranteed and no specific outcomes are promised.

No Refund Policy

Your satisfaction with our offerings is very important to us. However, due to the extensive time, effort, and care invested in creating and providing these offerings, we adhere to a strict no-refund policy. By purchasing or using any of our offerings, you acknowledge and agree that all sales are final. Unless required by law or explicitly stated in connection with a specific payment (e.g., deposits that are refundable in certain circumstances, where specified), we do not provide refunds for any portion of your payment for our programs, retreats, or other services.

In the event of any conflict between these Terms and the Agreement below, the terms of the Agreement will control for purposes of retreat-related matters.

Additional Agreement for Sacred Flame of the Rose Costa Rica Immersion

Neko Three Sixty/Nicole Elko, Emily Zachar, and Zata LLC d/b/a Soul Healing Collective (each a “Facilitator” and together, the “Facilitators”) are facilitating the Sacred Flame of the Rose Costa Rica Immersion experience (the “Retreat”), which is an optional add-on to the Sovereign Together 4-Month Initiation program. Participants must register for and participate in the Sovereign Together 4-Month Initiation program in order to participate in the Retreat.

I understand that all retreats carry significant risks. Although the Facilitators have taken reasonable and prudent steps to reduce foreseeable risks of the Retreat, they still exist. Accordingly, if applicable, in exchange for my being allowed to participate in the Retreat, I agree to be bound by each of the terms below (collectively, the “Agreement”):

1. Voluntary Participation. I understand and confirm that my participation in the Retreat is voluntary. I understand that I have autonomous choice of and am in charge of my own experience. I agree that what I put into this is what I will get out of this. I agree to show up for myself and to participate to the best of my ability, and to value my own voice, and to include my own voice and perspective as part of my participation.

2. Identification of Risks. I understand that there are certain dangers, hazards, and risks inherent in retreats and other recreational activities. More specifically, there are certain dangers, hazards, and risks inherent in certain activities conducted at the Retreat, including, but not limited to, weather conditions, swimming, hiking, and workshops, and snakes, insects, sleeping in private or shared spaces, bathing and eating and other residential activities (in overnight facilities), and other athletic and recreational programs (“Recreational Activities”), all of which are elective Retreat activities. I may voluntarily participate in some or all these activities. I also understand that medical facilities or treatment may be inadequate or unavailable during portions of the Retreat. I understand that my participation in the Retreat may involve risk of injury and loss, both to person and to property. I also understand that the risk of injury may include the possibility of permanent disability and death. There may be other risks not known to the Facilitators and not reasonably foreseeable at this time. I further understand that some of the premises, facilities, and equipment used in connection with the Retreat are not owned, maintained, or controlled by the Facilitators, but rather by the premises owners (the “Premises Owners”). I understand that this Release of Liability, Waiver, Indemnification, and Consent is intended to address all of the risks of any kind associated with my participation in any aspect of the Retreat, including, particularly, such risks created by actions, inactions, or negligence on the part of the Facilitators or their owners, contractors, directors, officers, employees, agents, volunteers, successors, or assigns (collectively, “Representatives”), including, but not limited to, risks created by the following: (a) my physical, emotional, and psychological limitations and/or discomfort; (b) the physical, emotional, and psychological limitations and/or discomfort of others; (c) the use and/or condition of premises on which various Retreat events occur; (d) the lack or inadequacy of policies, rules, or regulations with respect to the Retreat; (e) the failure of the Facilitators or their Representatives to foresee or protect me from actions, inactions, negligence, recklessness, or intentional or criminal misconduct of other persons; (f) the inadequacy or unavailability of medical facilities, treatment, and/or professionals; or (g) the lack or inadequacy of supervision by the Facilitators or their Representatives.

3. No Medical Advice Given; Assumption of Risks. Nothing taught or provided by the Facilitators, whether verbally or in writing, is to be considered or taken as medical advice. I agree to seek treatment and medical advice from my personal doctors. I assume all risks, known and unknown, foreseeable and unforeseeable, in any way connected with my participation in the Retreat, including its Recreational Activities, and I accept personal responsibility for any liability, personal injury, or economic or noneconomic damages or loss in any way connected with my participation. I represent to the Facilitators that I have health insurance that is adequate to cover treatment for any personal injuries I may sustain as a result of my participation in the Retreat, including its Recreational Activities.

4. Substances. I agree to refrain from alcohol and non-medicinal mind-altering drugs or substances for the duration of the Retreat, honoring the integrity of the container we are co-creating.

If I require prescribed or medicinal substances that may be mind-altering or impair my judgment or my ability to participate safely in the Retreat or its Recreational Activities, I will disclose that to the Facilitators. Regardless of such disclosure, I remain fully responsible for any and all consequences arising from my use or need for such prescribed or medicinal substances.

5. Nudity.  The Retreat includes spaces and times where nudity is allowed on a case by case basis. Toplessness is generally acceptable for any gender at any time, however genitals must be covered unless otherwise discussed with others who are present.

I understand that at any point in time, even though nudity may be welcomed in certain areas, it requires consent of the people around me, including asking a child's parents (not just asking the child/ren). If at any point, someone is uncomfortable with my nudity, I celebrate and honor their need for me to cover up. If at any point I feel uncomfortable with someone's nudity, I feel empowered to request that we be clothed in that space.

6. Release and Waiver. To the fullest extent permitted by applicable law, I release Facilitators and their Representatives from any and all liability for, and waive any and all reasonable claims, suits, damages, liabilities, losses, costs, settlements, and expenses, including claims for personal injury or economic or noneconomic damages or loss and related attorneys’ fees, arising out of my participation in the Retreat, including its Recreational Activities (each, a “Claim”), even if caused in whole or in part by the negligent acts or omissions or other misconduct of the Facilitators or any of their Representatives.

7. Limitation of Liability. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT OR ANY PROPOSAL, IN NO EVENT WILL FACILITATORS OR THEIR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification. I will indemnify, defend, and to hold harmless the Facilitators and their Representatives, and the Premises Owners, from and against any Claim or expense, including reasonable attorneys’ fees for the legal counsel of each of the Facilitators’ choice (including the cost of defending any Claim I might make, or that might be made on my behalf, that is released or waived by this instrument), in any way connected with a Claim.

9. Binding Effect. This instrument shall be binding upon my relatives, personal representatives, members, heirs, beneficiaries, next of kin, or assigns and shall inure to the benefit of the Facilitators, the Retreat, and their respective directors, officers, employees, agents, volunteers, successors, and assigns.

10. Consent to Medical Treatment. I authorize the Facilitators and their Representatives, and the Premises Owners, if present, to provide to me, through medical personnel of their choice, customary medical assistance, transportation, and emergency medical services should I require such assistance, transportation, or services as a result of injury or damage related to my participation in the Retreat. This consent does not impose a duty upon the Facilitators or their Representatives, or upon the Premises Owners, to provide such assistance, transportation, or services.

11. Severability. If any provision (or portion of any provision) of this instrument is held to be invalid or unenforceable, that provision shall be enforceable in part to the fullest extent permitted by law, and such invalidity or unenforceability shall not otherwise affect any other provision of this instrument.

12. Applicable Law. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Washington without giving effect to any choice or conflict of law provision or rule (whether of the State of Washington or any other jurisdiction) that would cause the application of laws of any jurisdiction other than those of the State of Washington.

13. Submission to Jurisdiction. Any legal suit, action or proceeding arising out of or relating to this Agreement or the Retreat will be instituted in the federal courts of the United States of America or the courts of the State of Washington, in each case located in the City of Seattle and King County, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding. The parties irrevocably and unconditionally waive any objection to the laying of venue of any suit, action or proceeding in such courts and irrevocably waive and agree not to plead or claim in any such court that any such suit, action or proceeding brought in any such court has been brought in an inconvenient forum.

14. Force Majeure. No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the affected party's reasonable control, including, without limitation: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of my agreement to this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities.

15. Media Release. I agree that my image, words, and voice, including from photos/videos and audio recordings taken and recorded during the Retreat, may be collected and retained by the Facilitators and their Representatives. I release my rights to these materials and give permission  to the Facilitators and their Representatives to use these materials for testimonial, marketing, and promotional purposes.

16. No Refund Policy.

17. Controlling terms. In the event of any conflict between the Terms above and this Agreement, the terms of this Agreement will control for purposes of Retreat-related matters.
